Gigsure Inc. (“Gigsure,” “we,” “us,” or “our”) operates an event insurance distribution platform through our website and related services (the “Platform”) in the United States. These Terms of Service (“Terms”) apply to your use of the Platform and any related offline services we may provide. By accessing or using the Platform, you agree to be bound by these Terms. If you are agreeing on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” and “your” will refer to that entity.

Changes to these Terms

We may modify these Terms or the Platform at any time at our sole discretion. The current Terms are always available on this page. If you do not agree to these Terms (including as amended), do not use the Platform. Continued use after changes constitutes acceptance. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and Gigsure regarding the Platform.

Eligibility

The Platform is directed at a general adult audience. By using the Platform you warrant that you have legal capacity to enter into these Terms (sufficient age and mental capacity to be legally bound). We do not knowingly collect information from persons under 18.

Insurance product terms

Each insurance product offered through the Platform is subject to the terms, conditions, exclusions, limitations, and deductibles set forth in the actual policy and any endorsements. Coverage is provided only as stated in your policy. Some products may not be available in all states or territories. We do not guarantee that any quote will result in an issued policy; underwriting and binding are subject to the insurer’s requirements.

You must provide accurate information

It is a condition of use that all information you provide (including personal and event details) is correct, current, and complete. If we believe the information you provide is inaccurate, fraudulent, incomplete, or in violation of these Terms, we may refuse access to the Platform and suspend or terminate your account.

Account registration

To access certain services you may need to create an account. You may register via our website or by logging in through supported third-party services (e.g., Google, Facebook). You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for safeguarding your password and for all activity under your account. Do not share your password; notify us promptly of any unauthorized use. We may suspend or terminate your account if you create more than one account or violate these Terms.

Payment

You must provide accurate payment method information. You authorize Gigsure and its payment processors to charge your designated payment method for premiums and any applicable fees. If you cancel before a purchase is confirmed, we will cancel any preauthorization or refund as appropriate. We will correct payment errors of which we become aware (e.g., by crediting or debiting the same payment method). Refunds for cancelled policies are subject to the policy terms and applicable law.

Your privacy is important to us. Please refer to our Privacy Policy. We use information we collect to arrange insurance and related services, communicate with you, and improve our products and services.

Disclaimer of warranties

YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK. THE PLATFORM AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GIGSURE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GIGSURE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. TO THE EXTENT APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SUCH EXCLUSIONS APPLY ONLY TO THE EXTENT PERMITTED.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GIGSURE (AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL) ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE. GIGSURE’S AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GIGSURE FOR INSURANCE PRODUCTS IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED US DOLLARS ($100). TO THE EXTENT APPLICABLE LAW DOES NOT ALLOW CERTAIN LIMITATIONS, THEY APPLY ONLY TO THE EXTENT PERMITTED.

Indemnity

You agree to defend, indemnify, and hold harmless Gigsure and its affiliates, officers, directors, employees, and agents from and against any claims, demands, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Platform.

Permitted use

You may use the Platform for your personal, lawful use in connection with obtaining event insurance. You may not copy, modify, scrape, frame, or distribute Platform content without our express permission. Use of the Platform by a competitor or for any purpose other than obtaining insurance for your own events may be prohibited. You may not use Gigsure’s trademarks or other intellectual property without authorization.

Dispute resolution

Except where prohibited by law, any dispute between you and Gigsure arising under these Terms may be resolved by binding arbitration on an individual basis (no class actions or class arbitrations). You and Gigsure each waive the right to a jury trial and to participate in a class action. The arbitration shall be conducted in accordance with applicable arbitration rules. The arbitrator’s award shall be consistent with the Limitation of Liability section above. Nothing in these Terms prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for intellectual property or other appropriate claims.

Product specifications and pricing

We strive to describe products and pricing accurately but do not warrant that descriptions, pricing, or other content are complete, accurate, or error-free. We reserve the right to correct errors and to refuse or cancel orders (including in the event of pricing or specification errors). If we have charged you before cancelling, we will issue a refund as appropriate.

Prohibited conduct

You may not use the Platform to send spam, distribute malware, compromise security, or engage in any activity that adversely affects the Platform or other users. We may investigate suspected violations and cooperate with law enforcement. We may suspend or terminate your access and take other corrective action we deem appropriate.
